Abstract

Most environmental lawyers - and most developers and conservationists - think of environmental law as a creature of the last 20 or 30 years. Instead of looking to our own legal past for answers to our environmental problems, we have tended to look overseas, particularly to the Unites States. But our legal history may be more useful than we realise. Doctrines which we thought we needed to import may be here already, if only we bother to look.
